بيان هام صادر عن الاتحاد الفلسطيني لكرة القدم تعقيبا على قرار "الفيفا"

 تلقى الاتحاد الفلسطيني لكرة القدم القرارات التي اعتمدها مجلس الاتحاد الدولي لكرة القدم (فيفا) بشأن نتائج كل من لجنة الحوكمة والتدقيق والامتثال (GACC)  ولجنة الانضباط، وذلك فيما يتعلق بالمقترح الذي قدمه الاتحاد إلى المؤتمر الرابع والسبعين للفيفا.

ويجدد الاتحاد الفلسطيني لكرة القدم تأكيده على احترامه الكامل للإطار المؤسسي للفيفا، ويُقر بالدور الذي تؤديه هيئاته القضائية وهيئات الحوكمة المستقلة.

ويشير الاتحاد إلى أن لجنة الانضباط في الفيفا قد خلصت إلى وجود انتهاكات بموجب المادة (13) من لائحة الانضباط، والمتعلقة بالسلوك المسيء وانتهاك مبادئ اللعب النظيف، وقد فرضت العقوبات المناسبة بناءً على ذلك.

وفي حين يُعد ذلك خطوة في الاتجاه الصحيح، يلاحظ الاتحاد الفلسطيني لكرة القدم أن هذه النتائج لا تعالج بشكل كامل نطاق وخطورة الانتهاكات التي أُثيرت في مقترحه الأصلي، بما في ذلك تلك المتعلقة بالتمييز بموجب المادة (4) من النظام الأساسي للفيفا، وغيرها من الادعاءات الخطيرة المدعومة بالأدلة المقدمة أمام الفيفا.

وبشكل خاص، يذكّر الاتحاد بأن الإجراءات الأساسية تضمنت أدلة موثقة على وجود سلوك تمييزي ممنهج، وإخفاقات مؤسسية في اتخاذ الإجراءات، وسلوك قد يرقى إلى مستوى التحريض على الإبادة الجماعية، كما ورد في المواد التي تم النظر فيها خلال التحقيق.

وفيما يتعلق بالقرار المرتبط بلجنة الحوكمة والتدقيق والامتثال، يلاحظ الاتحاد أن المجلس خلص إلى عدم المضي قدمًا في اتخاذ قرار موضوعي بشأن مسألة الإقليمية، وبدلًا من ذلك قرر إنشاء مسار إضافي من التفاعل.

ويؤكد الاتحاد الفلسطيني لكرة القدم أن هذه المسألة قيد البحث المستمر ضمن هياكل الفيفا منذ عام 2013، بما في ذلك من خلال نتائج لجنة المتابعة التابعة للفيفا، والتقييم القانوني المستقل الذي كلف به الفيفا، إضافة إلى المذكرات القانونية المتخصصة المقدمة من خبراء. وقد أسست هذه العمليات سجلًا متكاملًا ومتسقًا من الوقائع والأسس القانونية، بما في ذلك تحديد أندية المستوطنات الإسرائيلية التي تعمل ضمن الأراضي الفلسطينية المعترف بها دوليًا، وكذلك الأحكام ذات الصلة من النظام الأساسي للفيفا.

وفي ظل هذه المعطيات، يرى الاتحاد الفلسطيني لكرة القدم أن المسألة أصبحت ناضجة لاتخاذ قرار نهائي، وأن أي خطوات إجرائية إضافية في غياب مثل هذا القرار تثير مخاوف جدية بشأن التطبيق الفعّال للإطار التنظيمي للفيفا.

وفي ضوء قرارات المجلس، سيباشر الاتحاد الفلسطيني لكرة القدم اتخاذ جميع الخطوات المناسبة ضمن إطار لوائح الفيفا والمسارات القانونية المتاحة، لضمان صون حقوقه كاتحاد عضو، وتطبيق النظام الأساسي للفيفا بشكل متسق ودون استثناء.

ويؤكد الاتحاد التزامه بالانخراط البنّاء ضمن منظومة الفيفا، مع السعي لتحقيق الوضوح والمساءلة والحسم في هذه القضايا الممتدة منذ سنوات.

وسيُعقد مؤتمر صحفي يوم الثلاثاء الموافق 24 آذار/مارس، الساعة 12:00 ظهرًا، في أكاديمية جوزيف بلاتر في البيرة، لعرض مزيد من التفاصيل وبيان الخطوات المقبلة.

Palestine Football Association

The Palestine Football Association (PFA) takes note of the decisions adopted by the FIFA Council concerning the findings of both the Governance, Audit and Compliance Committee (GACC) and the Disciplinary Committee in relation to the PFA’s proposal submitted to the FIFA 74th Congress.

The PFA reiterates its full respect for FIFA’s institutional framework and acknowledges the role of its independent judicial and governance bodies.

The PFA notes that the FIFA Disciplinary Committee has found violations under Article 13 of the FIFA Disciplinary Code, relating to offensive behaviour and breaches of the principles of fair play, and has imposed corresponding sanctions.

While this constitutes a step in the right direction, the PFA observes that the findings do not fully address the scope and gravity of the violations raised in its original proposal, including those relating to discrimination under Article 4 of the FIFA Statutes and other serious allegations supported by the evidentiary record before FIFA.

In particular, the PFA recalls that the underlying proceedings included substantiated evidence of systemic discriminatory conduct, institutional failures to act, and conduct capable of amounting to incitement to genocide, as reflected in the materials considered during the investigation.

With regard to the GACC-related decision, the PFA notes the Council’s conclusion not to proceed with a substantive determination on the territoriality issue and to establish a further process of engagement.

The PFA respectfully recalls that this matter has been under continuous consideration within FIFA structures since 2013, including through the findings of the FIFA Monitoring Committee, the independent legal assessment commissioned by FIFA, and extensive expert submissions. These processes have established a consistent and comprehensive factual and legal record, including the identification of Israeli settlement clubs operating in the internationally recognized territory of Palestine and the applicable provisions of the FIFA Statutes.

In these circumstances, the PFA considers that the matter is ripe for a final determination and that further procedural steps, in the absence of such determination, raise serious concerns as to the effective application of FIFA’s regulatory framework.

In light of the Council’s decisions, the PFA will now proceed to pursue all appropriate next steps within the framework of FIFA regulations and applicable legal avenues to ensure that its rights as a member association are fully upheld and that the FIFA Statutes are applied consistently and without exception.

The PFA remains committed to engaging constructively within FIFA while seeking clarity, accountability, and finality on these long-standing issues.

The PFA will hold a press conference on Tuesday, 24 March, at 12:00 PM at the Joseph Blatter Academy in Al-Bireh to present further details and outline the next steps.
